What types of work permits are available in Canada?

There are two main types of work permits in Canada.

1. Employer-Specific Work Permit This permit allows you to work in Canada according to the conditions specified on your Work Permit, which include working for a specific employer and adhering to other applicable restrictions. Before you submit your application, your Canadian employer must complete certain prerequisite steps. For many positions, the employer is required to obtain a positive Labour Market Impact Assessment (LMIA). In other cases, the employment may be LMIA-exempt. If you already have a Canadian employer, we can assess your situation and assist you in preparing the documents for your Work Permit application.

2. Open Work Permit An Open Work Permit is not tied to a specific job or employer; however, it can only be issued under specific circumstances outlined in the immigration regulations. Eligibility for an Open Work Permit depends on the applicant's unique situation. We can review the specific circumstances of your case to determine whether you meet the requirements for one of the Open Work Permit categories.

Is an LMIA required to obtain a Work Permit?

A Labour Market Impact Assessment (LMIA) may be required from an employer before a foreign worker can apply for an employer-specific Work Permit.

However, an LMIA is not required in all cases. Certain employment categories may be exempt from the LMIA requirement. Therefore, the first step is to determine:

• which type of Work Permit is applicable;
• whether the employer needs an LMIA;
• whether an LMIA exemption can be applied;
• what documents the employer must provide;
• what documents the applicant needs to prepare.
